Reasons Why a Workers’ Compensation Claim May Be Denied in South Carolina.

The WCC may reject a claim for compensation for various reasons. Some of the most common reasons for rejecting such claims are as follows:

  • Time limits:  If the accident is not reported to the employer within 90 days, the right to compensation may be lost. Additionally, South Carolina law generally allows two years to file a workers’ compensation claim. However, in cases of repetitive motion injuries, such as carpal tunnel syndrome or occupational diseases, which take several months or years to develop, other time limits may apply. Individuals with these types of injuries or illnesses are granted two years from the date they became aware, or should have become aware, of their condition.
  • Incorrect classification:  If your employer classifies you as an independent contractor, you are not entitled to any compensation. Consult an experienced workers’ compensation attorney about how to appeal a denial due to incorrect classification.
  • Conduct:  Your employer could contest the benefits awarded, arguing that your injuries are a direct result of your conduct. Such arguments could be used in cases where the employee is accused of being drunk or under the influence of drugs at work.

How to Appeal a Rejected Claim for Compensation for a Work Accident

You can request a hearing by contacting the commissioner’s legal department directly and requesting a form, or by using the form on the WCC website.  Your case will be heard by a single workers’ compensation commissioner, who will rule on your claim for compensation.

If the sole commissioner denies your claim for benefits, you have the right to appeal that decision.  You can request that the full commission review your case, but the request must be made within 14 days of receiving the commissioner’s decision. You will be required to pay a filing fee of $150, although some specific cases are exempt from this fee.

If, after reviewing your case, the commission rejects your claim, you may appeal to the state courts.  A lawsuit must be filed within 30 days of receiving the commission’s decision. The appeal of the commission’s decision will be heard by the South Carolina Court of Appeals. If the court’s decision is appealed, the case will then go to the South Carolina Supreme Court.

How to Request a Hearing

Las apelaciones de los fallos emitidos por un panel de tres comisionados o por la comisión en pleno deben plantearse ante la Cámara de Apelaciones. El máximo tribunal de apelación en Carolina del Sur es la Corte Suprema estatal.
