What happens if my workers’ compensation claim is denied?

If your claim is denied, you have the right to appeal. Your attorney can file a Form 50 with the South Carolina Workers’ Compensation Commission requesting a hearing before a Commissioner. You will be able to present evidence and medical testimony to support your claim. If you disagree with the Commissioner’s ruling, you may appeal to a panel of Commissioners, then to the Circuit Court, and ultimately to the South Carolina Court of Appeals.
