In most cases, workers’ compensation is the exclusive remedy for on-the-job injuries, meaning you cannot also sue your employer. However, exceptions exist if your employer does not carry required workers’ compensation insurance, if your employer intentionally harmed you, or if a third party (other than your employer) contributed to your injury. In that last scenario, you may be able to file a separate third-party liability claim.
