HIPAA establishes that covered entities are not required to provide psychotherapy notes or information relating to a civil, criminal, or administrative action or proceeding. State law in South Carolina, however, establishes that health care providers that deny access out of a belief that seeing the records could endanger you or another person must still provide the individual with a summary of their history.

Under the HIPAA Privacy Rule, you also have the right to have a different health care professional review the decision to deny access to your records.
